Service Agreement

This document constitutes an agreement between the undersigned clients, hereinafter referred to as "Clients," and Violet Lin, hereinafter referred to as the "Photographer." Any amendments to this agreement may occur without prior notice.

Entire Agreement: This document constitutes the entirety of the understanding between the Clients and the Photographer.

Complete Trust: By engaging the Photographer's services, the Clients express complete trust in the Photographer's professionalism, character, photographic skills, and decision-making abilities.

  1. Booking Duration Consideration: Clients are encouraged to book longer durations to accommodate unforeseen circumstances and enhance the quality of the session.
  2. Pre-event Consultation: During booking, preliminary discussions will be conducted, where the client outlines their requirements, and the photographer provides suggestions regarding planning, logistics, and timing.
  3. Under-declaration of Requirements: The photographer reserves the right to refuse additional requirements or modify the quotation at any time if the client fails to provide crucial details (such as exact location, start and end times for photographer presence, urgent delivery, or special requests regarding photo privacy).
  4. Service Confirmation: Payment of the booking fee (deposit) confirms the photography service. Prior to payment of the booking fee, the quotation and availability may change. If the client cancels the shoot for any reason, the booking fee will not be refunded, as it is considered an actual loss to the photographer.
  5. Deposit Payment: If the client fails to pay the deposit within 24 hours after the photographer provides payment details, the client is responsible for double-checking the photographer's availability on the agreed date to prevent another client from booking the photographer. If the client pays the booking fee after another client has booked the photographer, the client needs to pay a 200 RMB administrative fee to the photographer, which will be deducted from the refunded booking fee.
  6. Full Payment: The remaining balance should be paid to the photographer at the beginning of the shoot day, deducting the booking fee, and can be paid in cash, Alipay, or WeChat Pay.
  7. Payment Methods: The booking fee is paid to the photographer's bank account via Alipay, WeChat Pay, or bank transfer. Cash payment is also acceptable, in addition to the listed payment methods.
  8. Consideration for Photography Duration: The client acknowledges and agrees that booking a longer duration of photography sessions is advisable. This extended time includes an additional 15 to 30 minutes before the scheduled shoot start. This provision is intended to address unforeseen circumstances and enhance the overall quality of the photography service.
  9. Actual Photography Session Duration: The duration includes equipment setup, breaks, and travel time. While the photographer always aims to arrive at the location early, there is no guarantee of starting the shoot early. If the client requests the photographer to start shooting early, this time will be included in the booking duration. For portrait sessions, the client understands the necessity of providing comprehensive briefs to the photographer. This briefing is crucial for establishing a shared creative vision and ensuring successful collaboration between the client and the photographer. For events, clients are encouraged to extend the booking time to cover various elements. This includes but is not limited to capturing landscapes, indoor details, culinary highlights, detailed shots of items, behind-the-scenes moments during setup, and guest arrivals. This extended coverage helps in forming a cohesive narrative, thoroughly documenting the essence and flow of the event.
  10. Actual Shooting Time: The shooting time includes setting up and dismantling equipment, such as flashlights and light modifiers if necessary. The booked time will commence from the scheduled time, including breaks and travel time. Although the photographer always aims to arrive early at the location, they are not bound to start shooting early. If the client requests the photographer to start shooting early, this time will be included in the booked time.
  11. Extension of Shooting Service Time: The extension of shooting service time depends on the photographer's availability and energy. Clients should inform the photographer in advance if there is a possibility of extending the shoot.
  12. Additional Booking Time Terms: Any additional time required beyond the initial booking duration will be charged in increments of 30 minutes or 1 hour, depending on the package. For example, if the client needs an extra 15 minutes, they will be charged based on the half-hour photography rate.

  1. Makeup and Hairstyling: It is advised that clients, subjects, and guests come prepared with their best makeup and hairstyle for any shoot, preferably done by trusted makeup artists and hairstylists the photographer has previously worked with.
  2. Inclement Weather: In the event of adverse weather conditions during outdoor shoots, clients will suggest alternative locations for the shoot. The photographer's booking time (start and end) remains unchanged.
  3. Meals: The photographer needs to eat to replenish energy and maintain a good state. If the photographer's attendance exceeds four hours, the client agrees to provide meals. If buffet meals are provided, it is automatically assumed that the client agrees to provide one for the photographer. The photographer may take meals or breaks during the shoot.
  4. Transportation Expenses: If the event involves multiple locations, transportation expenses will be provided by the client. The client should hire drivers and vehicles to ensure no delays occur.
  5. Principles of Cooperation: Clients and photographers agree to collaborate pleasantly and communicate with each other to achieve the best results within the understanding outlined in this contract. If necessary, it is recommended to provide an assistant to the photographer to indicate key individuals needing to be photographed. The photographer may also require assistance in organizing group photos. Clients also agree to inform the photographer of key events with sufficient advance notice, allowing the photographer time to prepare, such as bouquet tossing, cake cutting, awards, speeches, etc. Please note, not all guests enjoy being photographed. In such cases, the photographer will make their own decision but cannot be held responsible for inadequate photos of these individuals.
  6. Shooting Pace: The photographer adopts a cautious and unhurried shooting pace, resulting in high-quality and natural representative photos. As a standard practice, all photography packages automatically include shooting at this pace to ensure excellent images are created.
  7. Quality over Quantity: Clients agree that the quality of photos is more important than quantity and will not rush the photographer during the shoot.
  8. Flash (High-End) Photography Clause: For high-end packages including flash photography, the photographer will set up flashlights (illumination) and light modifiers. This process requires a considerable amount of time. Clients should kindly acknowledge that any changes in shooting locations or variations in sunlight conditions may require exposure tests. These tests include testing available light and flash power adjustments, which is a meticulous procedure that takes time. In situations where external factors (such as time constraints or venue restrictions) hinder the use of flash, the photographer will smoothly transition to available light photography to ensure high-quality images are delivered.
  9. Clarification on Natural Light Photography: In photography packages, the term "natural light photography" is used for the convenience of non-professional photographers. However, it is necessary to clarify that the expected term is "Available light" This includes ambient light, including natural light sources such as sunlight and artificial light sources such as fixtures, including readily available ceiling lights. In cases where the quality or quantity of available light is poor, the photographer reserves the right to enhance lighting conditions. This may involve installing a flash unit on top of the camera to ensure optimal image quality and capture the essence of the moment.
  10. Photography Schedule: The photographer's shooting schedule, workflow, and experience are aimed at providing clients with a set of excellent photos completed with a joyful spirit and enjoyed by all involved parties. Therefore, clients and photographers agree that punctuality and pleasant cooperation are crucial for producing outstanding photography results. If the shoot cannot proceed as scheduled (for example, if someone in the client group arrives extremely late at the location), the photographer cannot guarantee the shoot will proceed smoothly, although efforts will be made to accommodate.
  11. Disruption of Guests: In the spirit of pleasant cooperation, clients agree to prioritize the photographer's need to capture required photos over guests' own photography. If guests continually interrupt the photographer's work by taking photos of clients or subjects themselves, the photographer will not be held responsible for any missing photos.
  12. Venue-Specific Regulations: Please note that photographers may sometimes be subject to restrictions imposed by venue managers, limiting what can and cannot be done. For example, some art galleries insist on no flash photography, while others insist on photographers shooting from specific locations. In such cases, clients agree to accept any technical limitations imposed on the equipment used. Clients should be aware of the rules of the venue involved and negotiate with relevant personnel as necessary.
  13. Refusal to Shoot: The photographer reserves the right to refuse to shoot any photos they deem inappropriate, unfavorable, or potentially harmful to themselves or their equipment.

  1. Excellent Photographs: Excellent photographs refer to those deemed usable by the photographer. These exclude images that are deemed unclear, unattractive in appearance or expression, poorly composed, or similar (repetitive) in nature.
  2. Photo Selection Process: In packages where clients participate in the final photo selection, the photographer conducts initial screening of images. This preliminary selection aims to eliminate obviously undesirable photos, saving client time and project efficiency. Selected images are compiled into a PDF file in low-resolution format. Clients convey their choices by specifying corresponding photo numbers. It is acknowledged that, at this stage, unedited photos inaccurately represent the photographer's final work. These images should be strictly confidential and used only for review between the client and photographer. Clients further affirm their commitment not to use unedited photos in any manner. This understanding is crucial for maintaining the integrity of the photography process and respecting the photographer's artistic vision.
  3. Basic Editing: If unspecified, all photos undergo basic editing. Basic editing refers to adjustments in (1) exposure, (2) color, and (3) cropping according to the photographer's style. Clients entrust the photographer's style and do not have the right to reject or request modifications to given photos.
  4. Photo Quality: In certain circumstances, photo quality may be affected. These include shooting in strong sunlight, nighttime outdoor photography, dim indoor lighting without low white ceilings, subjects moving rapidly, and other unforeseen situations. It is advised that clients share all information with the photographer before shooting for better preparation. The photographer requires time to set up lighting equipment, test lighting, and dismantle equipment; in cases where clients directly or indirectly urge the photographer to expedite shooting for more photos, the photographer may not use his lighting equipment. Tones and brightness of photos may vary across different screens; the photographer uses his screen to determine the most suitable settings for photos to accommodate the desired effect.
  5. Shooting and Editing Style: Each photographer has their own shooting and editing style, including tones and exposure levels of each photo. Clients trust the photographer's style and do not expect the photographer to adhere to the style of other photographers.
  6. No Re-editing: Photo quality is subjective. Through collaboration with the photographer, clients trust that the photographer will strive to produce the highest quality photos in each situation and therefore accept the final photos.
  7. Photo Quantity: The photographer does not commit to shooting any specific quantity of photos during the shoot; clients trust that the photographer will strive to capture as many moments as possible at his own pace without pressuring the photographer. The number of event photos may depend on the planned activities; for portrait photos, it largely depends on client and subject cooperation and communication. Clients do not expect the photographer to continuously hold equipment during the shoot.

  1. Original/Unedited Files: The photographer does not provide original, unedited, or RAW format photos.
  2. File Format: The photographer will provide digital copies of selected images to the client in JPG format and will not include any physical prints.
  3. Photo Size: The maximum size for all final photos will be 2048 pixels on the longest side, with a resolution of 300 DPI, unless otherwise confirmed prior to the shoot. The photographer may provide photos at other resolutions at their discretion.
  4. Photo Delivery Schedule: Final photos will be delivered to the client approximately one month after the shoot or upon receipt of full payment by the photographer, whichever is later. The client acknowledges and understands that the photographer will strive to return the final photos as soon as possible but does not commit to delivering them by any specific date. Actual delivery time depends on the photographer's workload, order volume, and other unforeseen circumstances. The photographer reserves the right to notify the client of any changes to the delivery date at any time.
  5. Rush Service: The photographer may offer rush services. If the client requires early delivery of photos, the photographer will prioritize processing the client's photos, but specific timing will depend on the photographer's schedule. The fee for rush service depends on the actual shooting time and post-production time requested by the client. Any such requests, even for just one or two photos, must be made prior to confirming the shoot.
  6. Photo Delivery Method: For convenience, photos will be delivered online, and CDs or USB drives will not be provided, partly for environmental reasons. Completed photos will be uploaded to the photographer's cloud storage, and the photographer will provide the client with a link to download the files. Files will be deleted from the web server within one day of the client confirming receipt or within three days of the client receiving the link notification. Clients are advised to use a personal computer (not a mobile phone) and Wi-Fi (not mobile data) to download files, as they may be large and may require decompression.
  7. Photo Redelivery: The photographer is not responsible for retaining copies of photos. If the client requires the photographer to redeliver photos, an administrative fee will be charged, depending on the photographer's availability and the availability of the photos.

  1. Client Edits to Photos: Photos may not be edited in any way, including adding filters or cropping, without the prior written permission of the photographer.
  2. Copyright: The copyright of the photos belongs to the photographer. The photographer allows clients to reproduce photos under the following conditions: photos taken by the photographer are for personal use by the client and their friends and relatives only. Photos may not be sold, published, or used in any commercial manner without the prior written permission of the photographer.
  3. Authorization: The client authorizes the photographer and their legal representatives, heirs, and assigns to use the client's photos irrevocably and without restriction for editing, competitions, advertisements, and any other purposes, and to modify the photos in any way; and to copyright the photos. The client hereby releases the photographer and their legal representatives, heirs, and assigns from all liability and claims related to the photos.
  4. Photo Withdrawal: The photographer invests considerable effort in maintaining their portfolio, including their portfolio and social media accounts. Therefore, if the client changes their mind and wishes to restrict the photographer's use of the photos, the client must pay a privacy fee and compensate the photographer for their efforts. The photographer's efforts include writing headlines, creating web pages and social media posts, linking between web pages, and deleting web pages and posts, as well as revising affected other web pages and posts. The photographer will provide quotes at their rates, which may not be industry standard.
  5. Limitation of Liability: The client may request advice from the photographer, such as on locations. The photographer may provide recommendations based on their experience or research. If a recommendation is not feasible, such as if a location is unavailable, the photographer is not liable. If the photographer becomes ill or injured and unable to provide the aforementioned photography services, the photographer will endeavor to arrange for a substitute photographer. If a second photographer is available, they will shoot alone that day. If both photographers are unavailable and a substitute photographer cannot be found, liability is limited to refunding any payments received. The photographer has taken measures to prevent loss or damage to photos. However, photos may unfortunately be lost, stolen, or destroyed due to reasons beyond the photographer's control. In such cases, liability is limited to refunding a percentage of the service fee based on the provided photos or partial service fee.
  6. Privacy Policy: Please refer to the privacy policy page for complete details.

Please ensure that you understand the contents of this contract and agree to its terms. You can read the Q&A page for more information.
